SONKO OPPOSSES AN APPEAL BY DPP CHALLENGING HIS ACQUITAL

Former Nairobi Governor Mike mbuvi Sonko has raised an objection in the High court against an appeal filed by the DPP challenging his aquital in shs20m. graft case.

Lawyers John Khaminwa,Assa Nyakundi and Haron Ndubi who represents Sonko told Justice Nixon Sifuna that constitutionally the state cannot allowed to appeal in a criminal case.

They told the judge that Chief Magistrate Douglas Ogoti aquited Sonko under section 210 of the Criminal Procedure Code after finding that the evidence used against Sonko was discredited.
The DPP objected to Sonko’s sentiments stating that it has right to appeal the acquital in criminal cases.

Moses Athukunda who represents the DPP told the judge that the DPP enjoys rights of appeal like any other person.

The judge is set to deliver ruling on 11th November 2023.
