DPP IS YET TO SUPPLY EVIDENCE TO FORMER CS HENRY ROTICH

  1. The anti corruption court chief magistrate, Douglas Ogoti has expressed dismay over delayed supply of evidence to former finace minister Henry Rotich two years since he was charged with other accused persons.
    The trial magistrate said failure by the Prosecution to avail evidence and exhibits to the accused persons is unconstitutional.
    The court was moved by the defense lawyers Philip Nyachoti and Katwa Kigen to the effect that their clients have not been supplied with material evidence to enable them prepare for the trial.
    The lawyers argued that its the responsibility of the Dpp to disclose evidence to the accused person being charged this evidence must be given immediately upon the accused taking plea.
    They said The accused have continued to appear in court for mentions and the court cannot give a hearing date without disclosure.
    Rotich and his co accused are charged in connection with kimorer and Arror dams which tender was awarded to Italian companies.
    The matter will be mentioned on 19th march to confirm whether the prosecution has supplied documents to accused.
