Court dismisses petition against CBC

The high court has dismissed a petition challenging the implementation Competency-Based Curriculum (CBC), which replaced the 8-4-4 education system.
A three-judge bench  led by Justices Hedwig Ongundi, Antony Mrima, and Antony Ndung’u said that the rights of the children would be offended
 While they insisted on the children’s best interest, the judges said that granting the orders sought will cause disorder in the education system.
There was public participation and engagement including the education system,faith based organisation i,the public, key stakeholders in the and therefore it achieved the legal public participation participation thereby dismissing the allegations by lawyer Nelson Havi that there was no public participation.
It was the court decision that scrapping CBC will lead to loss of job employment and wastage of public and tax payers money that has already been used in rolling out the CBC
Similarly the court said that Best interest of a child shall be the primary consideration
It’s evident that CBC has been rolled and over 8 million children …teaching materials prepared …classrokms …govt made budget allocation and finds set aside.
On his part them Petitioner lawyer Nelson Havi said he was not going to appeal the decision and and termed the court finding as weird  .
“ i have told the court  that i will not appeal , perhaps its time we left kenyans to their own fate because such as struggles end up in this type of outcome. Perhaps we should not be wasting time fighting for the right of kenyans , i look forward to GenZ to find a better solution..”” said Havi after the judgement
