The high court will give a determination whether to bar or allow the state to deploy police to Haiti on 26th January 2024
The petition was filed by Dr. Ekuru Aokot’ and Third Way Alliance where stay orders were granted until the hearing and determination of the application.
Justice Chacha mwita today presided over the petition said he will deliver the ruling in the new term
During the hearing, the lawyer representing the petitioner Midenga Charles told the court ,the that police being an exclusive national service can not be deployed outside the country.

Lawyer Midenga added that in as much as the foreign country may require technical security support of the National Security Council, only Kenya Defence Forces can be deployed and not the National Police Service and police its members

The lawyers further challenged the powers of the Interior Cabinet Secretary Kithure Kindiki to order the Inspector General deployed police to Haiti stating that the IG can only take directions from the Interior CS on matters policy.

The petitioners’ lawyers added that the Inspector General can not take directions from the Interior CS on matters employment,transfers,promotion, and deployment of police as members of the National Police Service.

Emmanuel Bita appearing for the Attorney General told the court that the matter was filed prematurely before decision to deploy the police was made.
