A Nairobi man has been sentenced to two months in prison or a fine of Sh30,000 after pleading guilty to obtaining credit by false pretence.

Qurine Omondi Muteshi appeared before Milimani Chief Magistrate Lucas Onyina, where he admitted to incurring a debt of Sh22,760 at Vibanda Village Restaurant in Upper Hill, Nairobi County.

The court heard that on October 3, 2025, Muteshi, in the company of others not before court, consumed alcoholic drinks, food, and water at the restaurant but failed to settle the bill.

According to the prosecution, after eating and drinking, the accused pretended to be making a phone call and attempted to leave the premises without paying. He was intercepted by the restaurant staff as he was about to board a matatu.

Despite efforts by the management to persuade him to clear the bill, Muteshi refused to pay, prompting them to call officers from Capitol Hill Police Station, who arrested him.

The prosecution produced eight receipts from Vibanda Village Restaurant as exhibits in the case.

In mitigation, Muteshi told the court that he is a father of four and had some money but was unable to pay the full amount.

The court convicted him as charged and ordered him to pay a fine of Sh30,000 or serve two months in prison.
