Meru Senator Hon. Franklin Mithika Linturi has today moved to court seeking anticipatory bail pending arrest and charge. 
Mithika together with a business associate Emily Nkirote Buntai also sought orders of prohibition restraining the Directorate of Criminal Investigations and the DIrector of public prosecution from arresting , charging and prosecuting them with any criminal offenses relating or revolving around a credit facilities and securities as well as fraudulent changes at a compangy known as Atticon Limited as well as ownership and control pending the hearing and final determination of civil commercial and family disputes ongoing before courts.
Linturi says in an affidavit he jointly swore with emily nkirote that he is facing eminent arrest arrest charges and prosecution.
The DPP has recommended their arrest charges and prosecution for alleged criminal offenses revolving around loans , overdrafts and other facilities that the family bank extended on diverse dates to Atticon Limited Company.
Linturi also swears that he faces charges of fraudulent change of directorship , shareholding and share capital at Atticon Limited
He says in his application that he had seen a letter from the DCI to the DPP seeking advisory to arrest charge and prosecute him with various offenses amounting to 38counts .
He says the draft charges include, giving false information to a person employed in the public service , obtaining credit by false pretenses, personation, abuse of office, fraudulent procuring the registration of charge documents making false documents, intent to defraud and forgery.
He also says he has reason to believe of his eminent arrest from the various anonymous calls he has been receiving,
He say that he criminal charge are calculated to bring him humiliation and embarrassment.
Linturi says since he hold apolitical view of his choice the he should not be cajoled by the machinery of the state to do otherwise.
Investigators started in 2018 after complaints from mary kitany. Barons estate limited , Nonko holding , Collins Kipchumba , Dorothy Chepkurui and Billy odero Onyango
Linturi is currently embroiled in court tuzzle with Maryanne Kitany for divorce and property owenrship which include a modern home in Runda Estate
