A nairobi court has ordered Murder suspect Kevin Kang’ethe to be extradited to the United States of America (USA) to face murder charges
The Director of public prosecution petitioned the court to order the surrender of Kang’ethe to face trial in the USA following an extradition request made by the Attorney General of USA to the Attorney General of the Republic of Kenya.
Kang’ethe is accused of brutally killing his girlfriend Margaret Mbitu and later dumping her body in a car at an airport in Boston, US.
In a brief ruling chief magistrate lucas onyina said”The Respondent is hereby ordered to be returned and/or conveyed out Kenya and surrendered to the United States of America to face charges of the alleged first-degree murder in violation of Massachusettes General Law, Chapter 265, section 1, for which he was formally charged by criminal complaint in Case No, 23-CR-2559 in the District Court in Chelsea, Massachusetts,” Ruled the court
Chief Magistrate Lucas Onyina held that there is an extradition treaty between the government of the united states and the republic of Kenya
He further said that the material laid before the court established a link between Kang’ethe and the alleged offence of murder.
According to him, he’s under no duty to enquire into the merits of the charges to be preferred being the court handling the extradition proceedings and not the trial court
” If there is some evidence which discloses a connecting factor between the prisoner and the alleged offences, the magistrate should order the prisoner to be returned,” ruled Onyina
