High court grants interim relief to MP Nabii Nabwera in defamation suit

Lugari Member of Parliament Nabii Daraja Nabwera has obtained temporary protection from alleged defamatory statements circulating on social media, following an urgent application filed before the High Court.

The application, dated November 10, 2025, sought to restrain George Opunga Tamata from posting, publishing, or circulating statements linking the legislator to the disappearance of Munyuki High School Principal, Simon Isiaho Shange.

Court documents indicate that the respondent allegedly shared false, malicious, and injurious statements through several online platforms, including Kakamega Post, Malava Online, and Lugari Watchdog.

The posts reportedly implied that the MP was connected to the principal’s disappearance and death, with captions such as “Vanished after defying an MP” and “MP Nabii Daraja Nabwera, come clean on the death of this teacher.”

In his affidavit, Nabwera stated that the publications had subjected him to public ridicule and hostility, with threats directed at his home in Lugari, Kakamega County. He further claimed that the statements had severely tarnished his image and undermined his work as a public servant.

In an ex parte ruling, the court granted an interim injunction restraining the defendant from making further publications pending the determination of the suit.

An inter partes hearing, where both parties will present their submissions, has been scheduled for November 20, 2025.

Appearing for the MP, Advocate Danstan Omari told the court that the injunction was necessary to prevent further reputational damage, arguing that the defendant would suffer no prejudice from the temporary orders.

The ruling grants MP Nabwera short-term relief as the court prepares to hear the defamation matter in full.
