Court allows more victims to join petition against agrochemical companies

US based medic Dr George Kiongera has told the Milimani High Court that late former president Daniel arap Moi sold him a 20 acre land at Muthaiga nairobi for Sh515 million  in the year 2016 . 10 years ago.

Dr Kiongera bought the land through Maestro Connections Health Services Authority company where he is a director

He told the court he paid Moi’s lawyers through Jinaro Kibet of Triple Oklaw Advocates .

He told the judge that a search on the ownership of the property was conducted by lawyer Stephen Kipkenda.

The witness told the court that  lawyer stephen Kipkenda and Mr Jinaro Kibet introduced themselves as Moi’s lawyers and therefore I should deal with them in the transaction alongside former Baringo Central Senator Gedion Moi

The medic said the instructions that he deals with Gedion Moi, Mr Kipkenda and Mr Kibet were contained in a letter sent to him.

He started the process in 2016 with his wife to sign for the sale agreement of the 20- acre parcel of land which is also being claimed by a University.

The court heard that he paid for the parcel of the land in two tranches of Sh200million at a start

Dr Kiongera said he met Gedion, Moi’s son at a hotel in Westlands where they agreed he will buy the land

He testified that he did not pay immediately for the land since his Sh400million sunk with the collapsed Chase Bank Limited.

He said due to the delay in paying for the sale amount in time he was penalized Sh50million by Gedion Moi.

The medic said after paying the purchase price the land was transferred to him and therefore he told the judge “I am the bonafide and legal owner of the prime property.”

He urged the ELC Judge to declared the bonafide owner of the land which is also being claimed by the United States International University (USIU) and the Estate of the President.

The judge further heard that Dr Kiongera has sought to have the administrator of the estate of the late president to deposit in court Sh2.5billion to cater for his interests in the land.

The judge heard that the late President has stated in evidence presented at the Family Division of the High Court adjudicating over a succession dispute of his estate that “he does not know Dr Kiongera and he never sold the Muthaiga property to him.”

However, the lands court judge heard that nobody has contested the instructions of Moi to Triple Oklaw to sell the property to Maestro Connections Health Systems Limited.

Dr Kiongera said he met the widow of a former minister in Moi’s

Regime Margaret Magugu at the DCI offices where he had been summoned to explain how he bought the land from the late President.

He said police compared the signature of the late president in a bundle of documents.

Dr Kiongera is seeking orders to be declared the legal owner of the property claimed by other people who also claim they bought it from the late President.
