COURT AGREES WITH DUALE TO DEPLOY MILITAY TO CALM CHAOS

The high court constitutional division has agreed  with  CS Adan Duale to on the deployment of Kenya Defence Forces to calm chaos

Justice Lawrence Mugambi ruled that military deployment to assist the police is necessary to preserve peace and public safety and protect critical infrastructure.

“Given the eruption and loss of control of police during the demonstrations,  necessitating deployment of KDF which endangered life and property, the invocation of article 241(b) was properly invoked in the circumstances,” he said.

The judge said even though the intervention was justified, it’s clear that the public has not been fully appraised to the extent of the military involvement.

He said the terms, duration and areas of engagement be clearly defined and gazetted within the next two days.
