The Nairobi County Chief Officer for Environment, Geoffrey Mosiria, has escaped immediate conviction after the court suspended sentencing pending the hearing of his application challenging a contempt order.
Mosiria was expected to appear before Justices Oscar Angote, Charles Mbogo, and Ann Omoro for mitigation and sentencing following a judgment that found him and others in contempt of court.
Instead, a team of lawyers led by Danstan Omari, Cliff Ombeta, and Stanley Kinyanjui appeared on his behalf. They told the bench that their client was never personally served with the court order that stopped the construction of houses in Parklands, as required by law.
The lawyers informed the court that they had filed an urgent application seeking to set aside the contempt order and allow their client to present his case.
The bench allowed the application and directed Mosiria, through his lawyers, to serve the applicants in the matter.
The case will be mentioned on February 2, 2026, for the hearing of the application and possible determination on whether to lift or uphold the contempt order.
The applicants in the case,businessman Kamalkumar R. Sangahani, Jags Kaur, and Teddy Obiero,were represented by city lawyer Alfred Ndamiri.
They had moved to court seeking orders to stop the construction of certain buildings in the Parklands area of Nairobi County.
