Brian Mwenda the alleged fake lawyer will spend the long weekend in custody awaiting his lawyers to argue his release on bail.
When the matter came up for bail hearing yesterday the prosecution and the law society of Kenya rejected mwenda’s release on bail saying that if released he will not attend court.
In an affidavit filed by LSK sworn by Florence K. Muturi they allege that if released on bail, Mwenda will not attend court proceedings.
The court was told that Mwenda’s conduct demonstrates that he has no regards for the law, and that he evaded the police for more than four days.
“The accused managed to evade the police for more than four days and considering the resources at the DCI to trace and track suspects, this is a demonstration that the accused has the resources and ability to evade arrest. His conduct therefore, paints him as a possible flight risk.” Reads court papers
The prosecution also submitted that investigations are still ongoing and Mwenda might be charged with other criminal offences.
It took the whole afternoon for LSK and the prosecution to argue in opposition of Mwenda’s release on bail making it impossible for the defence lawyers to reply and apply for his release on bail.
